Throughout these Terms, “Boat & Sue”, “we”, “us”, or “our” refers to Boat & Sue (Pty) Ltd, Pretoria, South Africa.

By accessing our website, browsing, or purchasing from us, you agree to be bound by these Terms, together with our Privacy Policy and any other policies referenced herein. If you do not agree, please do not use our website or services.

Our online store is hosted on Wix, which provides the platform that enables us to sell our products to you.

2. ELIGIBILITY & ACCEPTABLE USE

By using this website, you confirm that:

  • You are at least 18 years old, or

  • You have consent from a parent or legal guardian.

You agree not to use our products, services, or website for any unlawful, fraudulent, or unauthorised purpose, nor to violate any applicable laws, including intellectual property laws.

Any misuse of the website, including the transmission of harmful code, interference with site security, or fraudulent activity, may result in immediate termination of access.

3. GENERAL CONDITIONS

We reserve the right to refuse service to anyone, at any time, for any lawful reason.

You understand that information submitted through the website (excluding payment details) may be transmitted across networks and adapted to technical requirements. Payment information is encrypted and handled securely by our payment service providers.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the website, services, or content without our prior written permission.

5. PRICING, AVAILABILITY & SERVICE CHANGES

Product prices, availability, and promotions are subject to change without notice.

We reserve the right to modify, suspend, or discontinue any product, service, or part of the website at any time without liability.

Where free shipping or promotional offers apply, thresholds are calculated after discounts or vouchers have been applied and will be shared in an invoice.

6. PRODUCTS

Certain products may be available in limited quantities. All purchases are subject to availability and our Returns Policy.

We make every effort to display products accurately; however, colours and appearance may vary depending on device settings.

We reserve the right to:

  • Limit quantities purchased per order, household, or customer

  • Cancel or refuse orders that appear fraudulent or intended for resale

  • Discontinue products at any time

We do not guarantee that products will meet individual expectations beyond what is required by law.

7. ORDER PROCESS, PRICING & PAYMENT

Boat & Sue operates using both order-form submissions and, where applicable, online ordering tools.

Where an order form is used (including the “Where to Buy” page), the following process applies:

  1. Order Submission
    Customers submit an order request by completing the online order form. Submitting an order form does not constitute acceptance of an order.

  2. Order Review & Quotation
    All order submissions are reviewed by Boat & Sue. Pricing, applicable discounts, and shipping costs are calculated and confirmed before acceptance.

  3. Invoice Issuance
    Once reviewed, an invoice will be issued to the customer via email. The invoice reflects the final agreed price, including delivery charges.

  4. Payment Confirmation
    Orders are confirmed only once full payment has been received and cleared in Boat & Sue’s bank account. Proof of payment may be requested.

  5. Order Acceptance & Dispatch
    Upon confirmation of payment, the order is accepted and prepared for dispatch in accordance with our Shipping Policy.

 

Boat & Sue reserves the right to decline or amend any order prior to payment confirmation.

8. BILLING & ACCOUNT INFORMATION

You agree to provide accurate, complete, and current billing and account information for all purchases and to update this information as needed.

We reserve the right to cancel or modify orders if information provided is inaccurate or if we suspect unauthorised, fraudulent, or reseller activity. Where possible, we will attempt to notify you using the contact details provided at the time of order submission.

For security purposes, Boat & Sue’s official banking details will never change without formal written notice issued directly by Boat & Sue using our verified contact details. We will never request payment to a new or alternative bank account via informal communication channels. Customers are encouraged to verify banking details before making payment.

9. THIRD-PARTY SERVICES & LINKS

We use third-party service providers to operate our business, including:

  • Website hosting and e-commerce platforms (e.g. Wix)

  • Payment processors

  • Courier and logistics partners

  • Marketing and communication platforms

These third parties process personal data only as required to perform their services and are obligated to protect your information.

Our website may contain links to third-party websites. We are not responsible for their content or privacy practices, and you engage with them at your own risk.

10. USER FEEDBACK & SUBMISSIONS

If you submit reviews, feedback, suggestions, or other content to Boat & Sue, you grant us a non-exclusive, royalty-free right to use, reproduce, publish, and distribute such content for lawful business purposes.

You agree that your submissions will not infringe on third-party rights, contain unlawful or offensive material, or include malicious code. You remain responsible for the content you submit.

Your personal information is collected, used, stored, and protected in accordance with our Privacy Policy and applicable South African data protection laws, including the Protection of Personal Information Act (POPIA).

By using our website or placing an order, you consent to such processing as described in our Privacy Policy.

If you opt in to receive marketing communications from us, you may unsubscribe at any time using the link provided in our emails or by contacting us directly.

Transactional communications relating to orders, deliveries, or account activity may still be sent as necessary.

13. SHIPPING POLICY

13.1 Shipping Partners & Fulfilment Method

Boat & Sue uses multiple courier partners to ensure reliable and cost-effective delivery. These may include:

  • PUDO

  • The Courier Guy

  • Aramex Store-to-Door

We reserve the right to select the most appropriate courier for each order based on delivery location, order size, urgency, and cost efficiency.

13.2 Delivery Timeframes

Estimated delivery times are as follows:

  • Aramex Store-to-Door: Approximately 3–7 working days

  • The Courier Guy and PUDO: Approximately 5–10 working days

Delivery timelines are estimates and may be affected by factors beyond our control, including courier delays, public holidays, or incorrect delivery information.

13.3 Shipping Costs

  • Shipping fees are calculated after submission of form unless free shipping applies

  • Where multiple courier options are available, the most cost-effective option may be selected

  • Free shipping thresholds may apply after discounts or vouchers have been deducted

13.4 Address Accuracy & Delivery Responsibility

Customers are responsible for ensuring delivery details are accurate and complete at checkout.

Once an order has been dispatched and handed over to the courier, delivery responsibility transfers to the courier, subject to applicable consumer protection laws.

14. ERRORS, INACCURACIES & OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability.

We reserve the right to correct such errors and to cancel or refuse orders placed based on incorrect information, even after an order has been submitted.

15. RETURNS & REFUNDS POLICY

Due to the nature of our products, returns are limited and handled in line with South African consumer protection legislation.

15.1 Refunds – When They Apply

Refunds will be issued only in the following circumstances:

  • Damaged goods

  • Undelivered goods

Refunds are issued to the original payment method unless otherwise agreed.

15.2 Damaged Goods

If your order arrives damaged, you must notify us within 24 hours of receipt.

To qualify for a refund:

  • Clear photographic evidence of the damage must be provided

  • A brief description of the issue must be included

  • Proof must be emailed to: info@boatandsue.com

Once verified, damaged goods will be refunded in full.

15.3 Undelivered Goods

If your order is confirmed as undelivered:

  • A full refund will be issued for the affected items

16. PROHIBITED USES

You may not use the website or its content to:

  • Engage in unlawful, deceptive, or fraudulent activity

  • Infringe intellectual property rights

  • Harass, abuse, or discriminate against others

  • Upload viruses or malicious code

  • Collect personal information without consent

  • Interfere with website security or functionality

Violation of these rules may result in termination of access.

17. DISCLAIMER & LIMITATION OF LIABILITY

Our website, products, and services are provided “as is” and “as available”, without warranties of any kind, except where required by law.

To the fullest extent permitted under South African law, Boat & Sue shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our website or products.

Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

18. INDEMNIFICATION

You agree to indemnify and hold harmless Boat & Sue, its directors, employees, service providers, and partners from any claims or demands arising from your breach of these Terms or violation of applicable laws.

19. TERMINATION

These Terms remain in effect unless terminated by you or us. We may terminate or suspend access to the website without notice if we believe these Terms have been breached.

Any obligations incurred prior to termination will survive termination.

20. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain valid and enforceable.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other posted policies, constitute the entire agreement between you and Boat & Sue and supersede any prior agreements or communications.

22. GOVERNING LAW

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.

23. CHANGES TO THESE TERMS

We may update these Terms from time to time. Continued use of the website following any changes constitutes acceptance of the updated Terms.
